Professional indemnity insurance will provide cover for designers should a claim of negligence be made against you by a client who alleges that your work for them has caused them a financial loss.
A couple of examples could include:
Negligence
You are responsible for artworking a clients designs for a print run. The colour settings on the digital printer should have been recalibrated prior to print, and as a result the printed documents’ colours are incorrect and do not match the clients brand.
The printing needs to be redone and has delayed the mailout of the document. The client alleges that your negligence has delayed their project and makes a claim for revenues lost as a result of the delay.
Professional Indemnity insurance would respond to provide cover for your legal costs in this instance.
Breach of contract
You are contracted for 12 months to a client to assist their busy design team. You start work on another opportunity before your contract finishes which contravenes the terms of your contract. Your client is unhappy and decides to make a claim against you for breaching the terms of your contract.
Professional Indemnity insurance would respond to provide cover for your legal costs in this instance.
As an example quote: a design professional with an annual turnover of up to £50,000 per annum, with a £500,000 indemnity limit in any one claim, would pay as little as £192.00 per annum for professional indemnity insurance, which we think is great value considering the cover and peace of mind that you benefit from (Figure correct as of 22.11.2021).
Which other insurance policies can design professionals benefit from?
Apart from Professional Indemnity insurance (PI), designers are usually asked to carry Public Liability insurance (PL), especially if they work from their clients’ offices. In many contracts you are not allowed to begin any work without being able to prove you have PI and PL insurance in place.
As a freelance limited company owner, a claim can be made against you personally with unlimited personal liability, even after an unsuccessful claim against your limited company has ended. Directors and Officers insurance will protect you in this instance and is provided as part of our Business Combined Liabilities insurance.
If you employ staff, or you’re looking to employ a member of staff you will be required by law to carry a minimum of £5million of Employers’ Liability (EL) insurance.
Tax Enquiry and Legal Expenses insurance will provide cover for costs incurred from a legal occurrence or claim that your indemnity and liability insurance does not cover, including tax investigations.
